Commercial Litigation
We represent Pennsylvania and New Jersey professionals and group practices in both federal and state business litigation actions, including matters such as breach of contract claims and actions for the enforcement or invalidation of restrictive covenants. We are further prepared to handle claims arising out of business torts such as breach of fiduciary duty, intentional interference with contractual obligations and violation of trade secrets.

Disciplinary Litigation
We represent licensed professionals in protecting their property rights in their professional licenses in administrative actions initiated by the Pennsylvania Bureau of Professional Occupational Affairs or New Jersey Office of the Attorney General, Division of Consumer Affairs. These actions seek to sanction a professional through reprimands, fines, probation, suspension and/or license revocation for violation of practice rules and regulations. We further represent clients in seeking to prevent their exclusion from the Medicare, Medicaid and other federal health care programs in investigations and actions instituted by the Office of Inspector General.

Employment Litigation
Professional practices and professionals are not immune to employment problems affecting employers and employees. We represent employers and employees in various employment related matters, including employment discrimination cases (including sex, race, nationality, disability and age claims), cases involving the Americans with Disabilities Act, the Family Medical Leave Act, unemployment compensation matters, Department of Labor issues, wage claims, ERISA claims and similar state and federal claims.

Malpractice Litigation
We represent professionals and professional corporations to defend medical malpractice claims when malpractice insurance carriers are unavailable to provide a defense (e.g., where a professional corporation does not maintain corporate coverage) and/or are unwilling to provide indemnity coverage or are providing a defense under a reservation of rights.

Medical Staff Litigation
We have significant expertise providing representation to professionals who are under investigation by hospital committees for possible violation of medical staff bylaws and department rules, which could result in probation or loss of hospital staff privileges. We also provide representation at due process hearings conducted under the medical staff bylaws. Further, we are able to analyze and discuss those actions that could lead to National Practitioner Databank reporting.

Subpoena Requests and Protection of Patient Confidentiality
We are well versed in those laws, both federal and state, affecting patient confidentiality and the medical record. We offer representation, analysis and advice to health care practices that have been served with a Subpoena or other request for production of patient records to assure there is no breach of patient confidentiality laws if and when the practice produces such records.
